Acceptance of the terms
By creating an account, publishing a listing, sending a message, making an offer or using the platform, you agree to these Terms of Use and the linked rules, and you acknowledge the Privacy Notice.
Who may use the platform
Users must be legally able to enter into the transactions they arrange. Users under 16 may only use the service with the involvement and permission of a parent or legal guardian.
Role of Bonaire Marketplace
Bonaire Marketplace provides the online platform only. It is not the buyer, seller, owner of listed items, auctioneer, payment provider, delivery service, inspector or guarantor. Users arrange payment, inspection, collection and delivery directly with each other.
User accounts
The operator may restrict an account where there is fraud, misuse, security risk or serious rule-breaking.
- Provide accurate account information.
- Protect passwords and verification codes.
- Keep account access secure and do not allow unauthorized use.
- Notify the operator about suspected unauthorized access.
- Remain responsible for activity performed through your account.
Listings
The operator may edit visibility, hide or remove listings that are illegal, misleading, unsafe, duplicate, unavailable or against marketplace rules. The operator does not verify every listing.
- Listings must be lawful, accurate and placed in the correct category.
- Listings must describe condition and important defects.
- Listings must show a genuine price or clearly explained pricing.
- Listing images must be owned by the user or published with permission.
- Availability must stay current, and duplicates, spam and misleading keywords are not allowed.
Private messaging
Messaging may only be used for genuine marketplace communication. Reported conversations may be reviewed for moderation and safety.
- No spam, harassment, threats, phishing, scams or unrelated advertising.
- No illegal requests.
- No requests for passwords or verification codes.
- No attempts to obtain complete banking credentials.
- No attempts to obtain unnecessary identity-document copies.
Structured offers
Where available, a buyer may submit an offer. The seller may accept or reject it, and the buyer may withdraw an eligible pending offer where supported. The seller may accept only an eligible pending offer. Acceptance reserves the listing where implemented.
- Acceptance does not collect or hold money.
- Acceptance does not transfer ownership.
- Acceptance does not prove that the item exists or belongs to the seller.
- Acceptance does not guarantee completion.
- Both users must still confirm the final price, payment method, item condition, collection or delivery and any other transaction details.
Payments, collection and delivery
Bonaire Marketplace does not process payments, hold deposits, provide escrow, refund transactions, arrange shipping, arrange collection or guarantee delivery. Users choose their own payment and handover method and accept the associated risks. Do not send money merely because an offer was accepted. Inspect items before payment where practical.
User responsibility
Buyers are responsible for asking questions, inspecting goods, confirming ownership where relevant, deciding whether to proceed and choosing a safe payment method. Sellers are responsible for accurate listings, lawful ownership, disclosing defects, keeping availability current and fulfilling agreed arrangements where possible. Both parties are responsible for complying with applicable law.
Business sellers
Users acting commercially remain responsible for identifying themselves as a business where required, consumer information rules, product safety rules, tax obligations, warranty or return obligations where applicable and other business requirements. The platform does not currently determine whether someone is a business seller.
Prohibited use
Users may not use the platform to break the law, sell prohibited items, defraud others, harass or threaten others, impersonate another person or business, circumvent account restrictions, interfere with the platform, scrape or misuse data without permission, upload malware, attempt unauthorized access, manipulate listings, offers or reports, or abuse the reporting system.
Moderation and enforcement
The platform may hide or remove content, restrict features, restrict or suspend accounts, cancel or invalidate offers where necessary, review reported listings or conversations, preserve relevant records and cooperate with lawful authorities. Moderation may use user reports, automated signals and human review.
No verification or guarantees
The platform does not guarantee user identity, ownership, item condition, listing accuracy, availability, legality, safety, payment, delivery or completion of a transaction. The platform does not perform inspections or background checks.
Availability of the service
The service may be changed, interrupted or temporarily unavailable. Features may be added, changed or removed. The operator does not guarantee uninterrupted operation. Maintenance, security issues or third-party outages may affect access.
Liability
Users remain responsible for their own conduct and transactions. To the extent permitted by applicable law, the operator is not responsible for loss arising from another user's conduct, misleading listings, product condition, ownership disputes, payment, collection, delivery, failed transactions, unauthorized account use caused by a user's failure to protect credentials or third-party service interruptions. Nothing in these Terms removes rights or protections that cannot legally be excluded.
Account restriction and termination
Users may stop using the service at any time. The operator may restrict, suspend or terminate access for serious or repeated rule violations, fraud, abuse, security threats, illegal activity or legal requirements. Relevant records may still be retained as described in the Privacy Notice.
Changes to the terms
Terms may be updated for future use. The effective date will be updated. Material changes may be communicated through the platform or by email. Continued use after a change may mean acceptance where legally permitted.
Contact and applicable law
Questions can be sent to the configured contact email. Applicable law and competent courts depend on the operator, the transaction and the circumstances, and require final legal review before launch.
